Haudenosaunee Environmental News Report
October 2003

Prepared by Kanatiiosh (Barbara Gray)

This report shares current environmental issues and developments in Environmental and Federal Indian Law.  In this report, you will find three articles and our selected Website of the month.

The first article is a comment on Lauren Godshall's recent law review article in which she discusses protecting indigenous people, land and culture through the use of intellectual property rights under international environmental law.  Her article is innovative and could prove to be a useful strategy for protecting the Onkwehonweh

The second article is written in response to the United State Supreme Court's upholding of the 9th Circuit  Court of Appeals' ruling.  The Court held that aerial spraying is a "point source" pollution that requires a National Pollution Discharge Elimination System permit under the Clean Water Act.

The third article is about Jewelweed.  The article was inspired by the plant section in the HETF publication of the "words before all else."  The article talks mostly about identification of the plant.  It discusses some common medicinal uses and offers a recipe, but respects and acknowledges that there are other medicinal uses which are the traditional cultural property of the Haudenosaunee medicine people so these are not discussed.

The Website of the month highlights the newly created ECHO (Enforcement and Compliance History Online).  This Website may prove to be a beneficial tool for individuals and environmental groups to for keeping a watchful eye on polluting facilities within their areas.
